About the Commission

What does the Commission do?

The Commission is a Crown entity, set up under the Electricity Act, to oversee New Zealand’s electricity industry and markets. As the industry regulator, it seeks to ensure that electricity is produced and delivered to consumers in an efficient, fair, reliable and environmentally sustainable manner. It also promotes and facilitates the efficient use of electricity.

Does the Commission own the electricity industry?

No. The industry is comprised of a number of state and private-sector companies. It is not part of the Commission’s function to own or acquire electricity companies. The Commission is an independent regulator that makes decisions on the electricity industry in accordance with rules and regulations under the Electricity Act 1992.

Who oversees the Commission?

The Commission has a six-member board led by a chair. The members are appointed by the Minister of Energy, on the basis of their knowledge of, or experience in, the electricity industry, electricity markets, regulatory processes and public policy. 

Who pays for the Commission?

The Commission is funded by an annual appropriation from Parliament, recovered by way of a levy on the electricity industry. The Commission collects the levy from electricity companies on behalf of the government. Some electricity companies choose to pass on the levy to consumers.

Does the Commission set electricity prices?

No. The Commission seeks to ensure wholesale and retail electricity markets operate efficiently. It has no power to control wholesale or retail electricity prices. Complaints about overcharging by electricity companies are handled by the Commerce Commission.

How does the Commission reach regulatory decisions?

The Commission consults extensively with a range of people involved in, or affected by, the electricity industry. It maintains five standing advisory groups to help it develop market arrangements and give advice concerning rules and regulations. Advisory groups are comprised of industry and consumer experts, and are forums of discussion for many of the Commission’s work issues.
