Investigations and decisions

Notifications of decisions

Decisions by the EGR Committee and Board are notified and in some cases publicised.

  • Decisions and reasons for decisions to decline to pursue a notification are notified to the notifying participant and the party alleged to be in breach.
  • When an investigator is appointed to investigate an alleged breach, the investigator publicises the matter under investigation including the content of the formal notice sent to the party alleged to be in breach.
  • Settlement agreements approved by the Board
  • Decisions made by the EGR Committee or Board to not lay a formal complaint. The notifying participant and the parties who have joined the investigation are notified of the decision and that they may lay a formal complaint direct with the Rulings Panel.

Current Investigations – open for parties to join

Breaches alleged of Meridian Energy

The alleged breaches concern Meridian, as retailer, not accounting for the electricity under the installation control point (ICP) assigned, not updating the Registry, and not submitting the volumes to the Reconciliation Manager.

Investigations Closed with Settlement

Investigations where a settlement was achieved between the parties and the settlement was approved by the Board.

Settlements when approved by the Board are final and binding on all industry participants and the Board. The Board must publicise the terms of every settlement agreement approved.  

Investigations Closed with no settlement achieved

Investigations where a settlement was not able to be achieved and the Board decided not to lay a formal complaint  with the Rulings Panel.

To date there have been 16 notified investigations where a settlement was not able to be achieved and were closed with no further action.  In addition there has been one investigation where a settlement was achieved for most of the alleged breaches under investigation. For the breach not resolved by settlement, the Commission decided that no formal complaint should be laid.

For most of these investigations a settlement was not possible due to there being no other party to the investigation, either no parties joined or parties joined and then subsequently withdrew.
