Regulation 85 requires the Board to publicise the terms of every settlement approved under regulation 84(2) (a).
Investigations where a settlement was achieved between the parties and the settlement was approved by the Board.
To date 37 notified investigations have been closed by way of 33 settlements. (Four notified investigations were combined for settlement purposes with other investigations).
Settlements when approved by the Board are final and binding on all industry participants and the Board. The Board must publicise the terms of every settlement agreement approved.

The following settlement was agreed between Transpower NZ Ltd, Meridian Energy Ltd and Genesis Power Ltd in respect of a self-reported breach of the Electricity Governance Rules (2003) by Transpower NZ Limited as System Operator. The matter concerned the concerned the self-reported breach of a principal performance obligation (rule 2.2.5 of section II of part C) by failing to “Act as a reasonable and prudent system operator with the objective of ensuring frequency time error is not greater than five seconds of New Zealand standard time”

The following settlement was agreed between ESD Power Ltd, Simply Energy Ltd, Mighty River Power Ltd and Genesis Power Ltd in respect of alleged breaches of the Electricity Governance Rules (2003). The matter concerned the creation of new ICPs for a new embedded network where ICPs already existed on the the parent network. The settlement agrees to transfer ICPs, where they already exist, to the new embedded network rather than creating new ICPs.

The following settlement was agreed between Transpower NZ Ltd, Meridian Energy Ltd and The Market Place Company Ltd as Pricing Manager in respect of self reported breaches of the Electricity Governance Rules (2003) by Transpower NZ Limited as Grid Owner. The matter concerned the provision of incorrect metering information by the Grid Owner to the Pricing Manager for the North Makarewa grid exit point.

The settlement is in respect of alleged breaches of the Electricity Governance Rules 2003 by Stream Information Limited concerning compliance with the code of practice for metering installations.

This matter concerned the failure to comply with dispatch instructions issued for Kinleith power plant on 4 July 2007.

The Board has approved the following settlement agreed between Genesis Power Limited, Transpower New Zealand Limited as System Operator, Norske Skog Tasman Limited and Meridian Energy Limited in respect of alleged breaches of the Electricity Governance Rules 2003 by Genesis Power Limited. This matter concerned the failure to comply with dispatch instructions for fast instantaneous reserve (FIR) issued for Huntly power station and failure to reasonably estimate the FIR available on seven occasions between 16 January 2005 and 10 October 2006.

The Board has approved the following settlement agreed between The Market Place Company Limited as Clearing Manager, Genesis Energy Limited, and Contact Energy Limited in respect of self reported and admitted breaches of the Electricity Governance Rules 2003 and the Electricity Governance Regulations 2003 by the Clearing Manager. The rule breaches concerned the calculation and publishing of incorrect constrained on and off payments. This matter concerned the creation of an installation control point for the Puke Ariki Library in Taranaki on 1 March 2004.

The Board has approved the following settlement agreed between Unison Networks Ltd, Transpower NZ Ltd, Vector Ltd and Norske Skog Tasman Ltd in respect of self-reported breaches of the Electricity Governance Rules 2003 by Unison Networks Ltd. This concerned the reserve offers and compliance with the dispatch instructions issued to Unison Networks on 8 November and 1 December 2006.

The following settlement was agreed between Meridian Energy Ltd, Transpower NZ Ltd and Norske Skog Tasman Ltd in respect of self-reported breaches of the Electricity Governance Rules 2003 by Meridian Energy Ltd. This concerned the reserve offers and compliance with the dispatch instructions issued to Waitaki River Block on 4 December 2005.
The Board approved the settlement agreement but authorised the Chairman of the EGR Committee to send a warning letter to the Chief Executive Officer of Meridian Energy Ltd.

The Board approved the following settlement that was agreed by a number of parties in respect of an alleged breach of the Electricity Governance Rules (2003) by Transpower NZ Limited as System Operator concerning an incorrect constraint applied to the Scheduling Pricing and Dispatch software model for the Wairakei-Whakamaru circuit for the period 9 March 2005 to 22 December 2005.
